Basis for handling | (1) In the Plan for Deepening the Reform of the Party and State Organs, the marine environmental protection responsibilities of the State Oceanic Administration were transferred to the Ministry of Ecology and Environment to exercise the responsibilities of ecological and urban and rural pollution discharge supervision and administrative law enforcement, and strengthen environmental pollution control.
(2) Paragraph 2 of Article 51 of the Marine Environment Protection Law: oil-based mud and other toxic composite mud used in drilling shall not be discharged into the sea. The discharge of water-based mud, non-toxic composite mud and drilling cuttings must comply with relevant national regulations. (3) The Notice of the General Office of the Central Committee of the Communist Party of China and the General Office of the State Council on Printing and Distributing the Provisions on the Functional Allocation, Internal Organizations and Staffing of the Ministry of Ecology and Environment (Ting Zi [2018] No. 70) specifies that the Marine Ecological Environment Department of the Ministry of Ecology and Environment is responsible for the ecological environment protection against marine pollution damage caused by coastal and marine engineering construction projects and marine oil and gas exploration and development. (4) Article 30 of the Regulations on the Prevention and Control of Pollution Damage to the Marine Environment by Marine Engineering Construction Projects: Strictly control the addition of oil to water-based mud. If it is really necessary to add oil, it shall faithfully record and report the type and quantity of oil added to the marine competent department that originally approved the environmental impact statement of the project. It is prohibited to discharge water-based mud and drilling cuttings with oil content exceeding the national standards into the sea. |

Approval conditions | (1) The project environmental impact assessment document and oil spill emergency plan have been approved or filed by the competent department;
(2) The applied emission amount and mode meet the requirements of the project environmental impact assessment document; (3) Environmental protection measures shall be taken to discharge the oil content of mud drilling cuttings up to the standard; (4) The biological toxicity of mud has been inspected by a technical institution with metrological certification qualification and meets the national standards; (5) The content of mercury and cadmium in the barite added to the mud has been inspected by a technical agency with metrological certification qualification and meets the national standards.
If one of the conditions for approval is not met, approval shall not be granted. |

Application and acceptance | The applicant shall submit a written application and application materials. After preliminary review, the Ministry of Ecology and Environment shall handle the application and materials submitted by the applicant as follows:
1. If the application materials are complete and conform to the legal form, it shall be accepted and a notice of acceptance shall be issued; 2. If the application materials are incomplete or do not conform to the legal form, the applicant shall be informed of the contents that need to be supplemented and corrected within 5 working days; 3. According to the provisions of the approval authority, the application items that are not subject to the approval of the Ministry of Ecology and Environment shall not be accepted and the applicant shall be informed. |
Review and approval | After examination, the Ministry of Ecology and Environment shall make a decision to approve the qualified applicant and notify the applicant in writing; The Ministry of Ecology and Environment shall make a decision not to approve the unqualified applicant, notify the applicant in writing and explain the reasons. |
